IN THE STUDENT SENATE OF SUNY COLLEGE AT NEW PALTZ
Mr. Kaminski (for himself, Mr. Zacherman, Mr. Gordon, Mr. Gembitsky, Ms. (Ella) Kondrat, Ms. (Katy) Kondrat, Ms. Reynolds, Mr. Warren, Ms. Yanega, Ms. Flamenbaum, and Ms. Wild) introduced the following Resolution:
Whereas, a definition of "streaking" is "to make a sudden dash in public while naked" as defined in www.dictionary.com, and;
Whereas, the purpose of streaking is to have fun and to surprise, to shock people, and in some cases to send a message. It embodies an attitude of freedom and foolishness, combined with a feeling of counter-culture. The act is one of total silliness. Streaking is the chance to take a step out of your normally mundane lives and once again bring back that childlike playfulness that modern society has managed to nearly crush with all its boring rules and regulations, and;
Whereas, New Paltz students need to wake up and realize there is a parallel between the freedom-fighting 1960s and the turn of the century (2007)., and;
Whereas according to section 245.01 of New York State Penal Law, "Exposure of a person. A person is guilty of exposure if he appears in a public place in such a manner that the private or intimate parts of his body are unclothed or exposed ... This section shall not apply to the breastfeeding of infants or to any person entertaining or performing in a play, exhibition, show or entertainment." Streaking could be considered as entertainment., and;
Whereas, according to section 245.02 of New York State Penal Law, Promoting the exposure of a person. "Nothing in this section shall prevent the adoption by a city, town or village of a local law prohibiting the exposure of a person substantially as herein defined in a public place, at any time, whether or not such person is entertaining or performing in a play, exhibition, show or entertainment", and;
Whereas, streaking is legal on campuses such as: Dartmouth College, University of California, the University of Georgia, the University of Virginia, among other colleges, now:
Therefore, be it resolved:
A Resolution
That, the Student Senate empowers the executive to call for a free streaking policy on campus, and,That, SUNY New Paltz students have the option to streak as they please recognizing that streaking is entertainment {{#security:view|*}}
